Upon signing the request to ship the shipments, the sender agrees and acknowledges that he has read, understood and agreed to all the conditions listed below. These conditions define the controls, provisions and consequences of Esnad Cargo (hereinafter to referred to as Esnad Cargo) to ship the shipments.
1. Transport Document:
A / The sender acknowledges that the shipments are fully owned by him or he is authorized to transfer them and sign on behalf of their original owner on all these conditions, and the sender in solely responsible for any damage, costs or additional expenses that Esnad Cargo incurred due to his violation.
B / The sender must fill in all the data on the transport document with his acknowledge and make sure that the addresses are correct and Esnad Cargo is not responsible for the delay, damage, or loss. The sender must also clarify the number, type of shipments and the necessary precautions that the courier must take when transporting those shipments according to the rules in effect in this regard, and the sender shall be responsible to Esnad Cargo and others for any damage resulting from the inaccuracy, correctness and adequacy of the information that must be included in the transport document.
C / The sender’s signature on the bill of lading without any notes or reservations, acknowledging that the data contained therein are correct.
2. Conditions of shipments/ movable stuffs
Items can not be shipping or those whom need private transport or carefully carry.
1/ Prohibited, dangerous, or prohibited materials to be circulated legally, including but to limited to:
• All kinds of drugs and intoxicants.
• Local and foreign currency of all kinds, such as (gold – silver – precious metals).
• Firecrackers and all kinds or weapons
• Prohibited publications and materials that are inconsistent with Saudi traditions, morals, systems and laws.
2/ Items of extraordinary value, such as work of art, precious stones, metals, etc.
3/ Commercial papers such as checks, stocks, bills, account books, credit card, treasury bills, bonds, documents or seal for articles related to disputes, issues or otherwise.
4/ Perishable materials due to heat.
5/ Animals such as purebred horses, cattle, cats, etc.
6/ Hazardous materials such as toxins and acid.
7/ Compressed gas cylinders and liquid batteries.
8/ Fragile and fragile materials that need extra care in handling.
9/ Valuable items such as antiques, jewelry, watches, mobile phones, and prepaid calling cards.
10/ Flammable and combustible liquids.
11/ Cameras, televisions, radios, cassette recorders, video recorders and items seem previous.
12/ Items valued at (500) Saudi riyals and above.
13/ Medical items that need special care and materials that need refrigeration.
In case that the sender violates the conditions of transportation by transporting materials that may not be transported or shipping materials that require a contract for regular shipment, then Esnad Cargo Corporation is not fully responsible for any damage to the good or others, and the sender and the consignee are jointly responsible towards Esnad Cargo or others for violating the conditions of transport.
3. Refusal to transport shipments:
1/ Esnad Cargo has the full right to refuse the transport of any shipments according to its own discretion, if legal reasons exist that prevented it from providing the service.
2/ Esnad Cargo reserves the right to refuse the transport of shipments at any time, even after it acceptance of it, with informing the sender of this is the shipments can cause and delay or damage to other shipments or if they are prohibited according to the applicable laws or these conditions.
4. Open the shipments:
1/ Esnad Cargo has the full right to open shipments and inspecting them to ensure that they comply with the customer’s disclosure and able to ship.
2/ Esnad Cargo also had the full right to open shipments after receiving them, in the case that the competent authorities request that, and Esnad Cargo regarding this shall be considered a reliable document.
5. Loss or Damage of Shipments:
The sender and the consignee have the right, in case of damage to the shipments, to request Esnad Cargo in writing for compensation within one day work of receiving the shipments. The provisions mentioned in Article Eight of these conditions.
6. Delivery:
1/ The time and place of delivery of the shipment shall be the time and place agreed upon in the bill of lading, and in case that the time and place of delivery of the shipment are not specific, then the time and place shall be according to the customs, practices or customs observed in the profession, taking into account the circumstance that may lead to any delay.
2/ Esnad Cargo is not responsible for any delay in delivery, wrong delivery, damage, or loss of shipment assets if this occurs due to a reason beyond its control or because if the sender as a result of this violation of the conditions mentioned in this policy or the nature of the shipments or for emergency circumstances or force majeure.
3/ The delivery of shipments to the consignee shall be considered evidence of having delivered them according to the description indicated in the transport document, unless a written notification has been delivered by the consignee including the nature of loss or damage that occurred to the shipments within one work day of receiving them.
4/ If the shipments are not received by the consignee within 7 days from the date the shipments arrived in the city of recipient, then Esnad Cargo has the right to dispose of the shipments without any lability for them except as stipulated in the article, and the sender or the consignee is not entitled to claim compensation for that.
5/ Esnad Cargo maintains a documented record in which the procedures that were taken to deal with postal items that were unable to be delivered are kept for a period of no less that one calendar year from the date of action take.
6/ Esnad Cargo applies the procedures and rules announced on its platforms and service delivery outlets with postal items that could not be delivered to their owners due the recipient’s refusal to receive them or for any other reason by the beneficiary, taking into account these rules the number of attempts that must be made to make the receipt and the approval of these rules and procedures for the international rules followed in this regard.
7. Privacy:
Esnad Cargo is obligated to preserving confidentiality of the beneficiary’s information from postal services and protecting from infringement by any means, and to take all necessary measures to prevents access to, access, disclosure, publication, or modification of it in contravention of the regulation, and Esnad Cargo shall not disclose the beneficiaries’ information unless this disclosure is made. It is permitted under a legal justification in accordance with the regulations in force in the Kingdom, or upon the explicit consent of the beneficiary, or his official representative in this regard or in the direction of the authority, and any access to the information of its beneficiaries shall be restricted and any entry to their information is documented, and the request is determined and defined. The purposes of collecting and preserving the beneficiaries’ information, as well as preserving the content of postal materials and prohibiting those not authorized by a system to access them.
8. Obligations and responsibilities:
1/ Shipped goods must be sealed by the sender and packaged in a good way that allows transportation and handling, and the sender alone bears all responsibility in case of loss or damage to the transported goods as result of poor packaging, and if the nature of the goods require preparing them for transport in special preparation, the sender must do in a manner that protects them from loss he shall not expose people or other things to harm and shall be responsible for any damage resulting from his breach of this obligation.
2/ The sender bears full responsibility for any damage, loss, or additional expenses incurred by Esnad Cargo, including storage expenses, and calculating this value starts after 24 hours have passed from the last date of receipt.
3/ In case of damages, or delays to one of Esnad’s Cargo trips due to the type and content of the shipments, the sender and the consignee are jointly responsible of compensating Esnad Cargo or others for damages.
4/ Esnad Cargo has the right to return to the beneficiary of the postal service with any money that he paid on behalf of the beneficiary and related to the service subject of the contract, after obtaining the prior consent of the beneficiary on that, and providing proof of the payment of the amount to government agencies.
5/ Esnad Cargo is obligate to processing the complaint of the beneficiaries of the postal service within 10 days from the date of submitting the complaint, and send a text message (SMS, electronic or paper) about the handling of their complaint, and also provide them with reference numbers for their complaints, and notify them of the latest developments in handling their complaint and the expected new period for ending it, taking into account the specified period for processing the complaint.
6/ Esnad Cargo is obligated to save the beneficiary’s complaint from the postal service and all the procedure that were performed on it for a period of one calendar year from the date of closing the complaint.
7/ Esnad Cargo obligated to notify the beneficiaries of the service immediately when returning the amount paid upon cancelled it or compensation according condition of providing service.
8/ Esnad Cargo obligate to the lows, regulations decisions in the Kingdom that regulate the operations of receiving, collecting, and returning funds.
9/ Any beneficiaries to whom mail material that does not belong to him has been presented, or found, must inform Esnad Cargo through one of approved means of communication.
10/ Esnad Cargo obligate to keeping the postal services contracts provided to the beneficiaries for a period of no less that one calendar year, and the burden of proof of the beneficiary’s consent when there is any dispute is on Esnad Cargo alone.
11/ Esnad Cargo has the right to destroy, unload and withdraw shipments in case of necessity without incurring any compensation to the sender for this work.
12/ Esnad Cargo entitled to the transportation fare for what is delayed or damaged by the shipped goods due to force majeure or the mistake of the sender or the consignee or their agents or representatives or because of an undelaying or hidden defect in the goods or because of a decrease in volume or weight during transport for reasons related to the nature of the transported goods such as evaporation or drought, maturity, or any other reason that is outside the control of Esand Cargo and prevents it from implementing the terms of the contract, and Esnad Cargo is exempt from lability in all these cases.
13/ Shipping through Esnad Cargo is not covered by insurance, and that the maximum of the goods for a single transport document as mentioned in transport document, and that if the price of goods in not mentioned on the bill lading by the customer and the invoices indicating the value mentioned on the transport document are submitted before sending it, this is considered as approval. However, the value of the goods is less than 500 SR.
14/ In the event of loss or damage to the shipments and their loss or damage as a result of Esnad Cargo, the limit of lability of Esnad Cargo shall in no way exceed the value of the same for all parcels and damaged or lost goods in the event of complete damage no more than 500 SR per bill lading. As for the partial damage, it is estimated according of the government section that examines the damage parcels.
15/ In case of a delay in the delivery of the shipments beyond their agreed date between the two parties, and Esnad Cargo was responsible for the delay, then the limit of Esnad Cargo’s lability should not exceed the value of the transportation fee to be paid for the late parts, so that this responsibility does not exceed the value of the transportation fee of the total cargo according to the transport contract provided that the sender or the consignee submit a written notification.
• The sender acknowledges and agrees to completely exempt Esnad Cargo from lability in the following cases:
- One working day has passed since the consignee received the sent shipments and signed on receiving them.
- Delay or refusal of the consignee to receive the shipments for a period of more than 7 days from the date on which the shipments arrived in the city of the addressee.
- Loss, damage or delay cause by fault of the sender.
- Loss or damage due to traffic accident, regardless of the cause of them.
- Loss or damage due to theft if it from outside Esnad’s Cargo employees.
- Loss, damage, or delay beyond Esnad Cargo control, such as force majeure, which includes for example, disruptions to land or air transportation due to bad weather, outbreaks of fire, floods, wars, disputes, security disturbance, government decisions, labor problems or obligations that extend to Esnad Cargo.
9. General Provisions:
- The above conditions and instructions apply to all shipments and consignments
- The provisions of this bill lading are the basis for contracting, and in case of private contracting, the provisions of this bill lading shall remain in effect as long as they do not conflict with the provisions of the private contract.
- This bill lading is an integral part of the relevant regulations in force in the Kingdom of Saudi Arabia and cancel all provisions that contradict it.
